The appointment of an auditor is mandatory for any company as per The Companies Act,2013 to analyze and understand the company’s financial position so that management can use the information to meet its objectives.
First Auditor shall be appointed by Board of Directors within 30 days of incorporation of the company who shall hold the office till the conclusion of first AGM(Annual General Meeting). In case of failure to appoint so, shareholders shall appoint the auditor within 90 days of receiving intimation of failure to appoint from the Board of Directors.
In case of resignation of auditor, new auditor shall be appointed by the Board of Directors within 30 days of resignation. If the vacancy is caused due to death or disqualification of the auditor, shareholders shall fill the vacancy within a period of 3 months.
